Terms of Service
The plain terms of using Kept — what you can expect from us, and what we ask of you.
01Agreement
These terms are the agreement between you and Overweight Holdings LLC (“we”, “us”), which operates Kept, covering your use of the Kept website and app. By creating an account or using the service, you accept them. If you do not, please do not use the service.
02Your account
- You must be at least 16 years old to create an account.
- Give an email address you can actually receive mail at — it is how we reach you about the service and how account recovery works.
- Your account is yours alone. Keep your password to yourself, and tell us promptly if you believe someone else has access.
- You are responsible for what happens under your account.
03What you record stays yours
Your habits, marks, tasks, and reflections belong to you. We claim no ownership of them.
You grant us only the narrow permission needed to run the service — to store your entries, and to process and display them back to you. That permission ends when you delete the content or close your account. We do not publish your entries, show them to other users, or license them to anyone.
04Acceptable use
While using Kept, please do not:
- Break the law, or use the service to harm or harass anyone.
- Attempt to access another person's account or data.
- Probe, scan, overload, or otherwise interfere with the service or the infrastructure it runs on.
- Scrape or automate access at a scale that degrades the service for others.
- Resell, sublicense, or reverse-engineer the service.
05Not medical or professional advice
Kept is a personal record-keeping tool. Nothing in it — including reflections, patterns, and the weekly letter — is medical, psychological, financial, or professional advice. It is not a substitute for care from a qualified professional, and you should not rely on it as one. If you are in crisis, contact a local emergency service.
06Availability and changes
We aim to keep Kept running and to keep your record intact, but the service is provided as it is, without any promise of uninterrupted availability. We may add, change, or remove features, and we may suspend the service for maintenance.
If we ever discontinue the service, we will give reasonable notice and a way to export what you have recorded.
07Price
Kept is currently free to use. If we introduce paid features, we will say so clearly in advance, and we will not start charging for an existing account without notice and your explicit agreement.
08Ending the agreement
You may stop using Kept at any time and ask us to close your account by writing to faithfully@overweightholdings.com. We may suspend or close an account that breaks these terms, or that we are required to close by law. When an account closes, its entries are deleted as described in the Privacy Policy.
09Disclaimer
To the fullest extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or continuously available, or that data will never be lost.
10Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Some jurisdictions do not allow these limits, in which case they apply only as far as that jurisdiction permits.
11Indemnity
You agree to indemnify us against claims, losses, and reasonable legal costs arising from your misuse of the service or your breach of these terms.
12Changes to these terms
We may update these terms. If a change materially affects your rights, we will update the date above and notify you in the app before it takes effect. Continuing to use the service after that means you accept the revised terms.
13Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. If any provision is found unenforceable, the rest stays in force.
